Explaining the changes in the provision, experts said the proposal will increase the compliance burden on e-commerce operators as they will have to deduct 2% TCS and deposit it with the government.

The measure, Nangia & Co director Rajat Mohan said, will not increase the incidence of taxation on consumers as the supplier will get tax credit for the TCS.

The model GST law provides for 1% TCS to be deducted by the e-commerce operators.

According to experts, this would mean that a similar amount will have to be levied on inter-state movement of goods, taking the total TCS deduction to 2% although burden on consumers will not increase.

Mohan further said in case of return of goods by the consumer, the e-commerce companies will not have to deduct TCS as there is no actual sale.

The draft model GST law does not provide any definition of ‘aggregators’, saying that the government would later come out with a notification specifying which type of businesses would be covered under the term.

Aggregators mainly include Ola, Uber and UrbanClap which work as platforms for providing transport and other services. The TCS provision will not apply to aggregators.

 

E-commerce companies will also have to file returns on the TCS deductions.

 

The model law has defined ‘electronic commerce’ as supply of goods or services, including digital products, over electronic network.

‘Electronic commerce operator’ would mean those persons who own, operate or manage digital or electronic facility or platform for electronic commerce.

Google shipped 33,000 units of Pixel to India as of October end, becoming the No 3 player for the month in the segment where the smartphone costs Rs 30,000 or more. Apple has trumped Samsung to capture the No 1 position in this segment. “A refreshing and feature-packed Pixel is making for a good proposition against Apple’s iPhone and Samsung’s S series,” analysts at Counterpoint Research said.

Apple had a 66% share of the high-end smartphone market as of last month, as shipments of iPhone 7 and 7 Plus outdid those of Samsung Galaxy S7 and other variants. Samsung had a 23% share. “Google does not want to miss out on the opportunities and is leaving no stones unturned with heavy spend on marketing. Going by spends on advertisement and offers provided by the company, Pixel is sure to maintain its market share if not extend it in the quarter,” Counterpoint said.

The search giant, which started selling its first made-by-Google phone in India on October 25, was offering no-cost EMIs starting Rs 3,167 for all online and offline purchases. It was also offering cashback of Rs 7,000 for HDFC card holders who wanted to buy the phone, which has a starting price of Rs 57,000.

 

Google had also run an exchange programme on Flipkart, which took pre-orders from October 13 to November 25, where an extra discount of Rs 5,000 was offered. While Google didn’t share the advertising expenditure, it has run a 360 degree campaign in the top seven cities, print and digital, to build the brand.

Lenovo India that owns two brands — Lenovo and Motorola, almost doubled revenue on a large base during 2015-16, while Oppo more than quadrupled sales, edging closer to the Rs 1,000 crore milestone in just the second year of its operations in the country.

Xiaomi, on the other hand, clocked record sales of over 2 million units in the July-September quarter, its highest in India since it started operations, paving the way for a record year with the company selling more than a million phones in October.

Lenovo India’s turnover touched Rs 10,484 crore in 2015-16 compared with Rs 5,602.84 crore the fiscal before, aided by expansion of the Lenovo brand smartphones in the offline channel and success of its Motorola brand in online sales.

China’s largest smartphone maker Oppo’s sale in India grew to Rs 934 crore last fiscal as compared to Rs 211.5 crore in 2014-15, as per the filings. For Xiaomi too, an expansion in the offline market and adding new online partners through the year, coupled with large product portfolio and manufacturing capacity to meet demand, have lead to a 150% volumes growth.

According to the Hong Kong–based market tracker Counterpoint Research, the share of Chinese brands has increased from 18% to 32% in the past one year in the Indian smartphone market driven by growth of players like Xiaomi, Oppo, Vivo and Lenovo.

 

But the biggest loser in this battle is Micromax. ET recently reported Micromax’s decline in annual revenues for the first time in 2015-16 when sales fell by 6% at Rs 9,825.46 crore as against Rs 10,450.47 crore in the previous year. Even in 2014-15, Micromax sales grew 47%.

 

As per IDC, Lenovo-Motorola also overtook Micromax as the second largest smartphone maker in India in the quarter ended September.

Expansion in the offline market and adding new online partners through the year, coupled with large product portfolio and manufacturing capacity to meet consumer demand, have lead to a 150% growth in volumes sales in the quarter, compared to 2015.

“We crossed 2 million plus sales in one quarter in third quarter for the first time, compared with our performance last year, we have attained more than 150% growth year-on-year,” Manu Jain, head of India operations said, citing International Data Corporation (IDC). Third quarter this year was the best for the smartphone industry with the highest ever number of smartphones shipped into India – 32.3 million.

“Mi India has been warmly welcomed by users, which is why we are one of the fastest growing brands in the smartphone industry today – one out of every four smartphones sold online was Xiaomi,” he added.

Huffman was receiving insult comments from this particular community and decided to fiddle with the comments for “about an hour.”

Huffman, who operates with username spez on the website said in his post, “Yep. I messed with the “f*** u/spez” comments, replacing “spez” with r/the_donald mods for about an hour… As the CEO, I shouldn’t play such games, and it’s all fixed now.

Our community team is pretty pissed at me, so I most assuredly won’t do this again.”

Addressing another issue referred to as “Pizzagate” regarding a popular conspiracy theory that tries to link Hillary Clinton with a secret paedophile ring, Huffman said, “It’s been a long week here trying to unwind the r/pizzagate stuff. As much as we try to maintain a good relationship with you all, it does get old getting called a paedophile constantly.”

Reddit banned the “Pizzagate” conspiracy board from its website on Thursday citing its policy against posting personal information of other people.

Even though Huffman has said that he will not be making changes to the user comments in future, the site might end up losing some trust from its users after the entire episode.

As per the Geekbench listing, a new entry level device with the name Nokia Pixel is seen running Android 7.0.1 Nougat. The smartphone is also seen powered by a Qualcomm Snapdragon 200 SoC coupled with 1GB of RAM. The CPU is a dual-core variant at a clock speed of 1.19GHz. It is also said to support Quick Charge 3.0 technology inside to charge the battery. Under the tests run by Geekbench, the Nokia Pixel scored 404 on the single-core test while it resulted with 661 on the multi-core test. It is likely the name of the smartphone will change before being commercially launched.

 

Nokia’s D1C is already in limelight with its launch anticipated to happen next year at MWC. The Nokia D1C in September was listed on Geekbench that quite revealed the specifications under its hood. There are other smartphones that have appeared as well in public and are rumoured to be launched at MWC – Nokia 5320, Nokia 1490.

Recently, according to a Chinese tipster, Nokia’s unnamed upcoming smartphone is said to feature a 5.2-inch or 5.5-inch screen size. iPhone 7 Allegedly Burns Woman While SleepingAn Australian woman has alleged that she got severe burns due to a charging iPhone 7. The woman shared the experience in a Facebook post and claimed that her recently bought iPhone 7 was on charging while she fell asleep on it.

“I recently purchased an Apple iPhone 7 and accidentally fell asleep with my arm on my phone whilst it was charging. I was woken up by sudden pain, pins and needles, numbness and shortness of breath,” Melanie Tan Pelaez wrote in her Facebook post.

Notably, the reported incident occurred last month and Pelaez claims that she informed Apple’s “executive team” through their website. Apple took the iPhone 7 for its internal testing though Pelaez is yet to hear anything from Apple.
Pelaez told Fairfax Media that she repeatedly wrote to Apple for taking some action in the case though received no response from the Cupertino-based company. The delay in response from Apple forced Pelaez to make the issue public. After the post became viral and was covered by media, Pelaez said Apple contacted her to find out how she was, but added that there were no answers that could be provided yet from the investigation. She added that Apple then offered a replacement phone, however, she refused one.
“I have been an iPhone user since the beginning and have never had an issue or concern, so it’s really scary and disappointing that something like this happened and can happen to someone else,” she added in her post.

Of course, it is not very wise to cover an electronic device – especially when it is charging. Most such devices without active cooling systems like fans are designed to radiate heat into the atmosphere. Also, prolonged exposure to even ‘warm’ devices can cause burns, making the entire case just an example of what not to do with a charging smartphone. Apple on its own iPhone user guide, in the Important safety information section, notes that sleeping or sitting on iPhone that’s in use or charging, or on the Lightning to USB Cable while it is plugged into a power source.

This is not the first case where a user has received burns because of iPhone. Earlier this year, a man in New South Wales reportedly sustained severe burns when his iPhone 6 exploded in his back pocket. The burn was so severe that he had to undergo skin graft surgery. In 2014, an eighth-grade student in the US received burn injuries when her iPhone blew and caught fire in her back pocket while she was in her school classroom.

To be noted is that these incidents have been isolated, and no conclusive evidence has been provided that show the devices themselves to be at fault. Lithium ion batteries, the most ubiquitous sources of power for portable devices, are certainly not the safest technology. While there are usually multiple fail-safes built in, these batteries have been known to explosively discharge if they malfunction, are misused, or disposed off incorrectly. While the recently reported incident of the Australian woman sustaining burns is not directly attributable to the battery on the iPhone 7, it just serves to highlight that care must always be taken to handle modern electronic devices in manner recommended by the manufacturer.
